Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Aerlux ("Aerlux," "we," "us," or "our") and govern your use of our mobile app and website at aerlux.app (together, the "Service"). Please read them carefully. We've written them in plain English where we can.

Short version: Be honest, follow the law, and don't abuse the Service. Your collection data is yours. If and when you use the marketplace, Aerlux is the venue that connects buyers and sellers and charges a fee on completed sales — but the sale itself is between you and the other person. The Service is provided "as is," and our liability is limited.

1. Acceptance of these Terms

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility

The catalog features (building and managing your collection, PDF export) are open to users of all ages, subject to the children's-privacy rules in our Privacy Policy.
The marketplace features (buying and selling) are restricted to users 18 years of age or older, because most jurisdictions do not permit minors to enter binding sales contracts.
You represent that the information you provide is accurate and that you are legally able to enter into these Terms.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account.
Notify us promptly if you suspect unauthorized use of your account.
You may have only one account unless we agree otherwise. Don't impersonate others or create accounts to evade a suspension.

4. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial collection management — and, where you qualify, to buy and sell through the marketplace. We may update, change, or discontinue features at any time.

5. Your content

You own your content. The model entries, photos, descriptions, and other material you add ("Your Content") remain yours.
License to us. You grant Aerlux a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service to you (for example, to sync your collection across your devices, generate exports, and — for items you list for sale — show the listing photo to potential buyers). This license ends when you delete the content or your account, except for content already shared with a buyer in a completed transaction and backups retained as described in the Privacy Policy.
Your responsibility. You represent that you have the rights to the content you upload and that it does not infringe anyone else's rights or violate any law.

6. Acceptable use

You agree not to:

Break the law, infringe intellectual-property or privacy rights, or facilitate any of the above.
Upload malware, attempt to breach or probe our security, scrape the Service, or reverse-engineer it except where that restriction is prohibited by law.
List counterfeit, stolen, or misrepresented items; commit fraud; or manipulate ratings or listings.
Harass, threaten, or abuse other users or our staff.
Use the Service to send spam or unsolicited marketing.

We may remove content or suspend accounts that violate these Terms.

7. Marketplace

The marketplace lets collectors list items for sale and buy from one another. The following applies when (and where) the marketplace is available to you.

7.1 Aerlux is a venue, not a party to the sale

Each sale is a contract between the buyer and the seller. Aerlux provides the platform and payment facilitation but is not the buyer or seller, does not take title to items, and does not guarantee the quality, safety, authenticity, or legality of any item, or the accuracy of any listing.

7.2 Sellers

You must accurately describe your item, have the right to sell it, and ship it promptly once a sale completes.
You authorize Aerlux and our payments provider to facilitate the transaction, deduct applicable fees, and route the remainder to you.

7.3 Buyers

You agree to pay the listed price plus any disclosed fees and to communicate in good faith.
Review listings carefully — items are sold by individual collectors, not by Aerlux.

7.4 Payments, escrow, and shipping

Payments are processed by Stripe / Stripe Connect. By transacting, you also agree to Stripe's applicable terms. Where we offer it, funds may be held until the buyer confirms receipt before release to the seller. You are responsible for any taxes, customs, or duties that apply to your sale or purchase.

7.5 Disputes

Buyers and sellers should first try to resolve disputes with each other. Aerlux may, but is not obligated to, assist or mediate, and may reverse, hold, or cancel transactions in cases of suspected fraud or policy violations.

8. Fees

Building and managing your catalog is free, subject to any usage limits we publish.
On completed marketplace sales, Aerlux charges a marketplace fee of 8% of the sale price, deducted at the time of sale. Stripe's own processing fees may also apply and are disclosed at checkout.
We may introduce optional paid plans or features in the future; their pricing and terms will be disclosed before you purchase.

9. Intellectual property

The Aerlux name, logo, wordmark, "Your collection. Secured." tagline, the app's design, and all related software and content (excluding Your Content) are owned by Aerlux and protected by intellectual-property laws. You may not use our branding without our prior written permission.

10. Third-party services

The Service relies on third parties (including Supabase for hosting and authentication, and Stripe for payments). Your use of those features may also be subject to those providers' terms. We are not responsible for third-party services we do not control.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any item listed by another user is as described. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Aerlux and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or collection value, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the total fees you paid us in the 12 months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Aerlux and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your marketplace transactions, or your violation of these Terms or the law.

14. Suspension and termination

You may stop using the Service and delete your account at any time (see the Privacy Policy for how deletion works).
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or for prolonged inactivity, with notice where practicable.
Sections that by their nature should survive termination (including content license for completed sales, fees owed, disclaimers, limitation of liability, and indemnification) will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws rules. You agree that the state and federal courts located in Washington will have exclusive jurisdiction over any dispute arising out of these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, for material changes, give you notice in the app or by email before they take effect. Continued use after the changes take effect means you accept the updated Terms.
